Guidance notes for social services departments when applying for passports on behalf of 'looked after children'

These notes provide general advice for social services departments when making passport applications on behalf of children subject to care/supervision orders or accommodated by voluntary agreement.

This guidance is to help local authorities Children’s Services departments make passport applications for children in their care.

The following information applies to passport applications made on behalf of children in local authority care:

• in England and Wales:
  • under section 31 of the Children Act 1989,
  • under interim care orders under section 38 of the Children Act 1989
  • and accommodated under section 20 of the Children Act 1989 or Section 76 of the Social Services and Well-being (Wales) Act 2014
• in Scotland:
  • using parental responsibility orders under section 11 of the Children (Scotland) Act 1995
  • using Permanence Orders issued under the Adoption and Children (Scotland) Act 2007
  • compulsory supervision requirements issued under section 83 of the Children’s Hearings (Scotland) Act 2011
  • and accommodated under section 25 of the Children (Scotland) Act 1995
• in Northern Ireland under:
  • under article 50 of the Children (Northern Ireland) Order 1995
  • under article 57 of the Children (Northern Ireland) Act 1995
  • and accommodated under article 21 of the Children (Northern Ireland) Order 1995
