This code of practice provides guidance on the use by public authorities of Part II of the Regulation of Investigatory Powers Act 2000 to authorise covert surveillance that is likely to result in the obtaining of private information about a person. The code also provides guidance on entry to , or interference with, property or with wireless telegraphy by public authorities under section 5 of the Intelligence Services Act 1994 or Part III of the Police Act 1997.

This code should be readily accessible to members of any relevant public authority seeking to use the Regulation of Investigatory Powers Act 2000 to authorise covert surveillance that is likely to result in the obtaining of private information on a person. Where covert surveillance activities are unlikely to result in the obtaining of private information about a person, or where there is a separate legal basis for such activities, neither the Act nor this code need apply. The Act provides that all codes of practice relating to the Act are admissible as evidence in criminal and civil proceedings.
